is designed to sidestep legislative action.
Rep. Lamar Smith (R-Texas), top Republican
on the House Judiciary Committee this morning
released the internal Department of Homeland
Security (DHS) memo obtained by Senator
Chuck Grassley (R-Iowa).
"The document shows
the Obama administration
scheming to allow millions
of illegal immigrants to stay
and work in the United States,"
Smith said.
"The Obama administration

Arizona Gov. Jan Brewer
submitted Thursday an appeal
to a federal judge to lift a temporary
suspension of key parts of a controversial
immigration law.
Brewer's office said
it asked the Federal Court of Appeals
of the Ninth District in San Francisco to
initiate an expedited appeals process and
to begin hearings for SB 1070 by
mid-September.
Just hours before it was to take effect,
U.S. District Judge Susan Bolton on
Wednesday suspended the law's most
severe measures.

like free speech rights and the ability to criticize
politicians when they do things like nationalize 1/5

of that while you can.
Senator Majority Leader Harry Reid (D-NV)
has filed for cloture on the DISCLOSE Act,
S. 3628, which is intended to overturn the
Supreme Court's decision in Citizens United
and impose burdensome new disclosure
requirements.
The cloture vote will probably occur Tuesday
in a move that avoids committee hearings.
If Reid can get 60 votes,
then the Schumer/Van Hollen
Sedition Act of 2010 will proceed to a vote.
At that point,
he will only need 51 senators
who believe Congress has the ability
to circumvent and restrict the First Amendment.
Senator Schumer also introduced a new version
of S. 3628 which differs slightly from the version
passed in the House, H.R. 5175.
For example, it drops the ban on political speech
introduced by Dennis Kucinich (D-OH) by holders
of oil drilling leases on the Outer Continental Shelf,
which is a slight improvement over the House version.
But the differential treatment between corporations
and unions is still present in the new, refined, and
"improved" bill, as are all of the other worst
provisions of the original version

has released its updated federal budget projections.
By releasing the report late on Friday afternoon-
a longtime Washington tradition for stories that politicians
want to bury-the Obama Administration is effectively
admitting that its budget numbers will not be well-received.
The "Mid-Session Budget Review"
projects that this year's budget deficit will reach
$1.471 trillion, or 10 percent of the economy.
In nominal dollars,
it's the largest deficit in American history.
As a percentage of the economy,
it's the largest deficit since World War II.
This will be the second consecutive year
of trillion-dollar deficits that approach
10 percent of the economy.
By comparison, the previous
post-World War II record was
6 percent of the economy in 1983.
Under President George W. Bush,
deficits typically ranged between $160 billion
and $400 billion (around 3 percent of the economy).
And the Obama Administration concedes
that these large deficits are here to stay.
It projects another $1.4 trillion deficit in 2011,
followed by sustained deficits that never fall
below $698 billion.
The national debt held by the public-
$5.8 trillion at the end of 2008-would soar
to $18.5 trillion by the end of this decade.
These future deficits are driven
almost exclusively by rising spending.
President Obama's budget would push
inflation-adjusted federal spending past
$36,000 per household by 2020-
$12,000 above the level that prevailed
under President Bush.
Even President Obama's enormous
and anti-growth $3 trillion tax increase
proposal won't stop this spending spree

has shown great ambition and propensity to
engage in activities to which it was never

Obama sees the private sector as inherently evil,
as reflected in the fact that he refused to meet with
BP to establish a working relationship with the
company to cut through all the bureaucratic
red tape.
While BP attempts to cap
the Deep Water Horizon well, it
has to be remembered that the government
forced BP to drill at a depth of 5,000 feet,
one of the deepest wells ever drilled, creating
the crisis.
BP had wanted to drill at a depth of 500 feet.
The result of the blowout
has been that the government, Obama,
and Democrats in Congress have threatened
and talked down BP and its efforts.
On the one hand, they require BP to obtain
approvals from the government to move forward,
while on the other hand they vilify the BP president

who crossed the aisle, the Democrat-controlled
Senate Thursday handed President Obama what
could be regarded as his greatest victory to date --
approving the 2,315-page financial regulatory bill
two weeks after the House had passed the measure.
Titled the Frank-Dodd
Wall Street Reform and Consumer
Protection act, after Connecticut Sen.
Chris Dodd and Massachusetts Rep.
Barney Frank, the Democratic committee
chairmen who authored the bill, it's intended
to usher in the stiffest regulatory restrictions on
the American economy since the Great Depression.
Although the Democrats hold
a clear majority in the Senate, they
needed a super majority of 60 votes
to overcome a Republican filibuster.
Sen. Robert Byrd's death two weeks ago
left a seat vacant, causing Democrats to
scramble about to make sure they had
the votes needed for passage.
The problem was solved
when Republican Sens. Susan Collins
and Olympia Snowe, both of Maine,
and Sen. Scott Brown of Massachusetts
announced their support for the measure Monday

On Monday the Obama administration
reissued a ban on offshore oil drilling in
the gulf after federal courts twice invalidated
the first ban, calling it "arbitrary and capricious."
The new ban is, if anything,
more restrictive than the first,
thus guaranteeing even more job losses
for the already devastated Gulf region.
Meanwhile, Majority Leader
Harry Reid (D-NV) is set to introduce
a bill that will cap greenhouse gas emissions
from power plants.
Taken together,
the President's Cap and Ban approach
to energy policy will accomplish exactly
what he set out to do from the very first day
he was sworn into office :
Decrease the amount of carbon
the U.S. economy emits by drastically
increasing the cost of energy.
The mechanism Sen. Reid will use to cap
carbon emissions is Sen. Jeff Bingaman's
(D-NM) renewable electricity standard
(RES) legislation (the American Clean Energy
and Security Act), which caps carbon from
power plants by forcing them to produce a
growing percentage of the electricity they
produce from government-approved
renewable energy sources every year.
This is essentially
cap and trade but without the trade.
If these new renewable energy sources
were actually cost effective, there would
be no need to mandate them.
Cost-minimizing firms would
adopt the technology on their
own to stay competitive.
But renewable energy is not cost-effective.
It is significantly more expensive
than traditional fuels, hence the need
for the government mandates which will
raise everyone's energy costs.

rolling out new campaign titled, we kid you not,
"Yes, we did."
Did what exactly?
Waste nearly a trillion dollars
on an economic stimulus that by
every objective measure has completely
failed to perform as advertised?

A new CBS poll out today shows
that 74 percent of Americans believe
the Obama stimulus either damaged the
economy or had no effect.
Clearly the White House is on
a different planet than the rest of the country.
In another dispatch from Planet Obama,
the White House Council of Economic Advisers
released a report today purporting to prove that
President Obama's stimulus has saved or created
3 million jobs and is on track to meet its goal
of 3.5 million jobs by the end of this year.
Where do they come up this slop?
This White House has lost all
credibility on economic issues.
That is why a new Washington Post poll
released Tuesday again showed that a majority
of Americans disapprove of President Obama's
handling of the economy.
But forget the polls
and the hype emanating from the CEA.
Here are the cold hard facts :
The President's original target
for jobs creation set during the
campaign in the fall of 2008 was
2.5 million jobs.
But as employment fell
at the end of 2008, he increased
the employment target by 1 million
to 3.5 million jobs.
At the time, employment stood at
about 135.1 million, according to the
DOL's most commonly used measure.
This establishes the Obama jobs target
for December 2010 at 138.6 million.
It also establishes a basic trajectory
for employment the economy would
need to approximate to hit that target.
According to the latest jobs report,
total U.S. employment stood at almost
130.5 million in June, which means the
cumulative Obama jobs deficit-the
difference between the end target and
the current employment level-

produce from government-approved
renewable energy sources every year.
This is essentially
cap and trade but without the trade.
If these new renewable energy sources
were actually cost effective, there would
be no need to mandate them.
Cost-minimizing firms would
adopt the technology on their
own to stay competitive.
But renewable energy is not cost-effective.
It is significantly more expensive
than traditional fuels, hence the need
for the government mandates which will
raise everyone's energy costs.

Last week the Obama administration began
rolling out new campaign titled, we kid you not,
"Yes, we did."

A new CBS poll out today shows
that 74 percent of Americans believe
the Obama stimulus either damaged the

President Obama's stimulus has saved or created
3 million jobs and is on track to meet its goal

released Tuesday again showed that a majority
of Americans disapprove of President Obama's
handling of the economy.

for jobs creation set during the
campaign in the fall of 2008 was
2.5 million jobs.
But as employment fell
at the end of 2008, he increased
the employment target by 1 million
to 3.5 million jobs.
At the time, employment stood at
about 135.1 million, according to the
DOL's most commonly used measure.
This establishes the Obama jobs target
for December 2010 at 138.6 million.
It also establishes a basic trajectory
for employment the economy would
need to approximate to hit that target.

On June 30, in her confirmation hearings,
Solicitor General Elena Kagan gave a response
which gives me pause about her fitness to serve
on the Supreme Court.
Senator Tom Coburn, Republican of Oklahoma,
asked her view of the natural right to self-defense.
She responded, hesitantly, that she didn't have a
view of natural rights independent of the Constitution.
But natural rights independent
of the Constitution form the very fabric of it.
The Constitution could not have been written unless
we were an independent nation at the time we wrote it.
The life of the Constitution rests upon the
validity of the Declaration of Independence.
Recall that the author
of the Declaration states
that the authority by which we declared
our independence from Great Britain is
"the Laws of Nature and of Nature's God."
Thus, the very Constitution which Kagan would be
called upon to judge depends upon a natural right
which is independent of it.
The most fundamental question
for any judge is why laws exist at all.
Surely, laws exist to protect the personal security,
personal liberty, and private property of those
subject to them.
This must mean that the rights to these,
as Blackstone observed, exist independent
of the laws written to protect them.
Otherwise, any manner of laws could be written,
such as a law to tell us what foods we should eat
and in what proportions.
To say that she has no view on natural rights means
either she does not understand the origin and meaning
of the Constitution or she is in fundamental disagreement
with both.

A radically new wealth-generating natural resource
has emerged, one especially favored by the
Obama administration.
This is dependency, in which recipients of government
largess evolve from an unwelcome tax-eating burden
to a job-creating asset.
No wonder
many Americans welcome troublesome immigrants.
It is almost as if the 1849 Gold Rush days are here
again, but instead of prospectors panning for nuggets
at Sutter's Creek, entrepreneurs are packing their
minivans, formulating grant proposals, sharpening
resumes, and rushing to Arizona to strike it rich by
"mining" newly discovered clients.
Thanks to multiple government programs,
the proportion of Americans in some way dependent
on government largess has suddenly jumped by 31.2%
since 2001 after decades of much slower increases.
Even in inflation-adjusted dollars, America now
spends thirteen times more on public welfare than
it did in 1965.
Dependency has snowballed in health care, public
welfare, and housing, and the upward trend seems
likely to continue as Obama's statist polices take hold
and baby boomers retire.
Indeed, the president plans to spend
some $10.3 trillion in welfare over the next decades.
In a nutshell, Uncle Sam is replacing the family, the
church, private charities, and all other non-government
sources of assistance, and this means regular jobs
for the new caregivers.
And it feels good to work for Uncle Sam :
Benefits included, the average federal workers in
2008 earned double what those in the private sector
took home.
So it is hardly unexpected that since about January
2008, some 7.9 million private sectors jobs have
disappeared, while 590,000 public sector jobs were

which gives me pause about her fitness to serve
on the Supreme Court.
Senator Tom Coburn, Republican of Oklahoma,
asked her view of the natural right to self-defense.
She responded, hesitantly, that she didn't have a
view of natural rights independent of the Constitution.
But natural rights independent
of the Constitution form the very fabric of it.
The Constitution could not have been written unless
we were an independent nation at the time we wrote it.
The life of the Constitution rests upon the
validity of the Declaration of Independence.
Recall that the author
of the Declaration states
that the authority by which we declared
our independence from Great Britain is
"the Laws of Nature and of Nature's God."
Thus, the very Constitution which Kagan would be
called upon to judge depends upon a natural right
which is independent of it.
The most fundamental question
for any judge is why laws exist at all.
Surely, laws exist to protect the personal security,
personal liberty, and private property of those
subject to them.
This must mean that the rights to these,
as Blackstone observed, exist independent
of the laws written to protect them.
Otherwise, any manner of laws could be written,
such as a law to tell us what foods we should eat
and in what proportions.
To say that she has no view on natural rights means
either she does not understand the origin and meaning
of the Constitution or she is in fundamental disagreement
with both.

A radically new wealth-generating natural resource
has emerged, one especially favored by the
Obama administration.
This is dependency, in which recipients of government
largess evolve from an unwelcome tax-eating burden

resumes, and rushing to Arizona to strike it rich by

Thanks to multiple government programs,
the proportion of Americans in some way dependent
on government largess has suddenly jumped by 31.2%
since 2001 after decades of much slower increases.
Even in inflation-adjusted dollars, America now
spends thirteen times more on public welfare than
it did in 1965.
Dependency has snowballed in health care, public
welfare, and housing, and the upward trend seems
likely to continue as Obama's statist polices take hold
and baby boomers retire.
Indeed, the president plans to spend
some $10.3 trillion in welfare over the next decades.
In a nutshell, Uncle Sam is replacing the family, the
church, private charities, and all other non-government
sources of assistance, and this means regular jobs
for the new caregivers.
And it feels good to work for Uncle Sam :
Benefits included, the average federal workers in
2008 earned double what those in the private sector
took home.
So it is hardly unexpected that since about January
2008, some 7.9 million private sectors jobs have
disappeared, while 590,000 public sector jobs were

and/or Senate refuse to fund them -- bondholders
will get more and more nervous.
Eventually, they will realize that the less
solvent states are bankrupt and will refuse
to buy their debt.

Democrat voters by the year 2016 by way
of an amnesty for illegal aliens.
Then he denounced Republicans
for blocking a "bipartisan approach"
to that legislation.
Didn't happen, you say? Yes, it did.
The proposed transaction
was given a code name and reported
by the mainstream news media as
"comprehensive immigration reform."
Obama's problem is that over 75 percent of
Americans want to see genuine border security .
Yet Obama
and the Democratic majorities in the House and
Senate are again trying the old bait-and-switch
trick, which worked so well in 1986.
They want Americans to accept a new amnesty
as part of a "comprehensive plan" that includes
a promise of border security somewhere
down the road.
Americans are not buying it.
Citizens want to see the border secured now,
not as part of some dishonest deal for amnesty.
And that,
Mr. President, is a true bipartisan consensus.
It is amazing
how many otherwise intelligent people have
adopted the lexicon of political correctness in
which the "bipartisanship" label can only be
attached to Democratic legislation, never to
