RICHMOND -
Virginia Attorney General
Ken Cuccinelli said he will file
a formal response as early as this
week to the federal government's
attempt to dismiss Virginia's legal
challenge to Obamacare.
In an exclusive interview with Heritage,
Cuccinelli said the federal government's
motion to dismiss, released last Monday,
was mostly predictable.
He said the attorney general's office
had already anticipated the government's
arguments and will have its response ready
on or before June 7.
"What they filed last Monday
was very much what we expected,"
Cuccinelli said in an interview
at his Richmond office.
"You never know exactly
how they're going to present it,
but we did expect them to move
to dismiss the case."
The legal maneuvering
puts Cuccinelli at the center
of the Obamacare court battle.
In addition to Virginia's lawsuit,
20 states have joined a legal
challenge from Florida.
Virginia is pursuing its own strategy
because its legislature adopted a law
protecting its citizens from
the individual mandate.
Cuccinelli said the stakes are high
and he expects Virginia's case -
and probably Florida's - to end up
before the Supreme Court within
the next two years.
"We are doing what the founders
expected states to do," Cuccinelli said.
"We are a check
in the checks and balances system
that was laid out by James Madison"

A little over a month into
the Gulf of Mexico oil spill,
the American public wants
answers- from the Obama
administration, from Congress
and from BP.
While there are still
many more questions
than currently available answers,
President Obama answered a few
and dodged others in his speech
last week .
He made a resounding push
for clean energy legislation and
referenced the House cap and
trade bill passed last year and the
one recently introduced in the Senate.
He also suspended or canceled a
number of lease sales off the coasts
of American waters and extended a
moratorium on deep-sea offshore oil
drilling permits.
The Gulf oil spill certainly presents
an unprecedented economic and
environmental disaster and challenge,
but it should not be used as an excuse
to ban offshore exploration and cancel
leases outright or to overreach and make
drilling prohibitively expensive.
Furthermore, it should not be used
to push clean energy agendas forward
that will impose a significant burden on
American families, American businesses,
and the American economy.
Similar to Rahm Emanuel's
"You don't ever want a crisis
to go to waste" statement, President
Obama urged both Democrats and
Republicans to move quickly to pass
cap and trade legislation.
This is not the solution
to America's energy needs
because cap and trade will
raise energy prices, kill jobs
and contract the economy.
If "clean energy"
legislation moves forward,
higher energy costs will spread
throughout the economy as producers
everywhere try to cover their higher
production costs by raising their product
prices, further impacting Americans.
The result will be
a much slower economy
and lost jobs at a time when
the top priority for Americans
is economic growth.
There are billions of barrels
of oil and trillions of cubic feet
of natural gas under these waters
that could possibly create tens of
thousands of jobs as well as create
revenues for financially strapped state
governments and increase revenues
for federal governments

realize that the state legislature also
passed a number of other measures
to protect its citizens.
While governments
from Los Angeles to Boston
to Highland Park, Illinois make
plans to avoid Arizona, many
conservatives, veterans, and gun
owners might want to consider the
other things Governor Brewer
signed in the last few months.
House Bill 2684
becomes law on 29 July
after Governor Brewer
signed it on May 3, 2010.
This law requires that
the nationally recognized
Prisoner of War/Missing in
Action Flag (POW/MIA) be
flown over the state capitol building,
superior court buildings, city or town
halls, and each county seat.
It also establishes
specific protocols of
how to properly display
the POW/MIA flag.
It is a fitting reminder
of the veterans and the
cost of the Vietnam War.
House Bill 2350
provides a tuition
waiver for Purple Heart
recipients who also have
a 50% or greater disability
from the Veterans Administration.
But if you're a wounded warrior,
don't plan on moving to Arizona
to take advantage of the benefit
-- written into the law is a stipulation
that the wounded trooper must have
been either a resident of Arizona or
stationed at an Arizona military
installation at the time of deployment
resulting in the injury to be eligible for
the tuition waiver.
The board of regents
of many universities attempted
to block similar legislation in the past.
This law provides the same tuition
waiver available to employees of
schools such as the University of
Arizona and Arizona State University.
Senate Bill 1108
will cause the liberal left,
and people like Chicago's
Mayor Daley, to continue to
talk about how terrible Arizona is.

Coming just five months before
the all-important November elections,
the bill is a blatant exercise in vote-buying
paid for with money we don't have.
But since the Democrats have added
$1.75 trillion to the national debt in
2009 alone, what's another $190
billion tacked onto the national debt?
Especially since its intent is
to energize the liberal base
(and quiet the unease of a
9.9% unemployment rate)
by transferring another $2,000
to every adult Obama-supporter
-- and this on top of the $787-billion
stimulus of 2009 and the $410-billion
omnibus spending bill that followed
shortly after.
Given the choice of ruinous spending
versus short-term political gain, the
left always chooses political gain.
As unemployment continues to rise
toward 10%, it should be obvious that
the earlier rounds of stimulus spending
have not been effective, and they have
not been effective because they were
not designed to be.
Rather, they were designed
in the most cunning fashion for
the sole purpose of securing power.
How else could one explain
unemployment rates that are
now on average nearly twice
what they were under
George W. Bush?
Surely the combined brainpower
of Larry Summers, Paul Volcker,
and Timothy Geithner, if not the
singular brainpower of their boss,
could have designed a fiscal policy
that would have stimulated
private-sector job growth -- for
example, by lowering corporate
taxes and eliminating regulation.
Instead,
Obama's policies have been
consistently anti-business and
anti-growth, and Volcker's promotion
of a European-style value-added tax is
simply another backdoor tax on growth.
When you seize business profits in
the way Obama has been doing, do

BP now drills in 5,000 feet
of ocean because these better
alternatives have been foreclosed
to the oil industry.
Environmental groups
have effectively stymied
this safe and relatively easy
production of oil in the name
of some higher but more
nebulous good.
Where they once rationalized their
campaign against oil companies based
upon the threat of environmental
degradation, environmental
groups now use the increasingly
dubious claims of global warming
to justify their obstruction.
As the policies of environmental groups
were a factor in what we now see in the
Gulf of Mexico, so they were in the 1989
Exxon Valdez disaster.
When huge quantities of oil
were discovered in Prudhoe Bay
on the North Shore of Alaska
in the mid-1960s, one issue among
many was the transportation of this oil
The safest approach
was a pipeline from the
North Shore directly to the northern
border of the contiguous United States.
As a member of the Sierra Club
at that time, I remember well the
relentless war that the Sierra Club
waged against both the drilling
and the pipeline.

Security has warned Texas law

at a firm that designs health care
facilities, notes: "We don't have the
primary care infrastructure in place
in America to cover the need.
Our clients are looking at and
preparing for more emergency
department volume, not less."
A big part of the problem :
a growing shortage of
primary care physicians.
The American Academy
of Family Physicians recently
predicted that by 2020, the United
States would have 40,000 fewer
family physicians than needed.
As the doc supply diminishes,
it will be become increasingly more
difficult to get a timely appointment.
Inevitably, more and more folks
will resort to emergency rooms to
get the medical attention they want.
But there is another,
even bigger problem,
rooted in the new law itself :
Roughly half of the 34 million
newly insured under Obamacare
will get their coverage via Medicaid,
a poorly performing welfare program.
Medicaid reimbursement rates
for physicians are so low that many
doctors simply refuse to accept
Medicaid patients.
Based on previous experience,
Medicaid expansion will not only
"crowd out" private insurance, but
will also swell the ranks of those
getting routine, non-urgent care
through hospital emergency rooms.
The result :
an even higher reliance
on emergency room care
among Medicaid beneficiaries
than among the uninsured.

The media immediately
picked up on this claim.
As Reuters summarized
the President's remarks :
[He] said
more than 80 percent of [the guns]
came from the United States
Except that, of course, was
not what the President said.
The President included
a crucial qualifier in his statement :
he was referring only to the
guns that Mexico has (with U.S.
assistance) been able to trace.
And in that context, the
President's claim is correct :
He was referring to a U.S.
Government Accountability
Office (GAO) report concluding
that, of the guns seized in Mexico
and given to the ATF for tracing
from 2004 through 2008,
approximately 87 percent
originated in the U.S.
But this number says nothing
about the percentage of guns
seized in Mexico that originated
in the U.S., because the U.S.
does not trace the majority
of guns seized in Mexico.
The argument the President made
'today' has been refuted again and
again, but it is not surprising that he
relied on it.
The only surprising fact
is that the President couched
his remarks in the context of a
request for an 'assault weapons'
ban, instead of in the context of
support for the OAS's
Inter-American
Convention Against
the Illicit Manufacturing
of and Trafficking in Firearms,
Ammunition, Explosives, and

Financial Regulations of the Global Commie Unionist Corporate Criminal Regimes ;
As the Senate continues to debate
financial regulation, two senators -
Olympia Snowe of Maine and Mark
Pryor of Arkansas - have proposed
an amendment to ensure that regulators
consider the effects of new rules
on small businesses.
Specifically, the two would require
the new Consumer Financial Protection
Bureau to convene a "Small Business
Review Panel" to assess the effect of
any new rules on small business before
formally proposing them.
Such "Small Business Review Panels"
were first authorized under a regulatory
reform bill signed by Bill Clinton in 1996.
With members representing small
businesses, these panels advise regulators
on the possible effects of new rules -
before the rules are formally proposed.
Currently, two agencies are required
to use these panels: the Environmental
Protection Agency and the Occupational
Safety and Health Administration, which
have them some 40 times over 14 years.
The proposed amendment would
extend their use to the CFPB as well.
These review panels
are no panacea for overregulation
The amendment has drawn
a surprising amount of criticism.
Review panels, they say,
provide small businesses a "privileged"
position in the rulemaking process, warning
that it would result in weaker regulations.
Instead, they are proposing a
substitute which would provide
for panels that would review
small business impacts after
rules are finalized.
In other words,
regulate first, consider

financial regulation, two senators -
Olympia Snowe of Maine and Mark
Pryor of Arkansas - have proposed
an amendment to ensure that regulators
consider the effects of new rules
on small businesses.
Specifically, the two would require
the new Consumer Financial Protection
Bureau to convene a "Small Business
Review Panel" to assess the effect of
any new rules on small business before
formally proposing them.
Such "Small Business Review Panels"
were first authorized under a regulatory
reform bill signed by Bill Clinton in 1996.
With members representing small
businesses, these panels advise regulators
on the possible effects of new rules -
before the rules are formally proposed.
Currently, two agencies are required
to use these panels: the Environmental
Protection Agency and the Occupational
Safety and Health Administration, which
have them some 40 times over 14 years.
The proposed amendment would
extend their use to the CFPB as well.
These review panels
are no panacea for overregulation
The amendment has drawn
a surprising amount of criticism.
Review panels, they say,
provide small businesses a "privileged"
position in the rulemaking process, warning
that it would result in weaker regulations.
Instead, they are proposing a
substitute which would provide
for panels that would review
small business impacts after
rules are finalized.
In other words,
regulate first, consider

Oil Tax Hikes of the Global Commie Unionist Corporate Criminal Regimes ;

on the cause of the oil spill,
lawmakers on Capitol Hill
appear to be focused on
liability limits and oil
tax increases.
The White House
and some Members of Congress
are pushing for a one-cent increase
per-barrel of oil produced - from
eight cents to nine.
In reality, this is an indirect gas tax
that will be passed onto the consumer.
Currently the direct federal gas tax
is 18.4 cents per gallon with the mean
state tax being 27.2 cents per gallon.
The purpose of the newly proposed
tax hike is to increase the amount of
funds available in the Oil Spill Liability
Trust Fund and ostensibly collect more
money for the clean up.
But the real purpose
is to make political ends meet.
Although it doesn't sound like much,
the Wall Street Journal reports that
"The one-cent increase would raise
about $5 billion over 10 years to help
offset the cost of the tax package, which
is nearing $200 billion.
The tax
could go to 10 cents a barrel in 2017."
Wait. What tax package?
Politico says,
"The added revenue is coveted
by tax writers, still struggling to find
close to $50 billion in offsets needed
to pay for an election-year package
of infrastructure investments and
popular tax break extensions."
This makes one wonder :
is this about cleaning up the
Gulf or making ends meet for
other political agendas?

the UK VAT during the campaign.
Of course, one day after taking office
they were laying the groundwork for an
increase in the UK VAT to 20 percent.
That would be a 5 percentage point
increase from the current
15 percent rate.
Not surprisingly,
Obama has already said he would

finds it necessary.
The VAT threat
will lurk in dark corners
until either Congress brings
the deficit under control or Obama
is ready to bring it out into the open.
